Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Focido mobile application and our website (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Focido is operated by the founders based in Spain (EU). We currently do not have a separate registered legal entity. If this changes, we will update these Terms accordingly.

1) Eligibility (16+)

The Service is intended for users 16 years of age or older. By using the Service, you represent that you meet this requirement.


2) The website

Our website is provided for product information, updates, and contacting us. Your use of the website is also subject to these Terms. Some website features may be provided by third parties (see “Third-party services”).


3) Account and access (App)

  • Login method: The app uses email magic link authentication. You are responsible for maintaining control of your email account and for all activity under your account.
  • Username: You may choose a public username. You are responsible for ensuring your username does not violate these Terms or applicable law (e.g., impersonation, hate speech, harassment).
  • Accurate information: You agree to provide accurate and up-to-date information where requested.
  • Account security: If you believe your account was compromised, contact us at [email protected].

4) The Service and community features (App)

Focido provides features for creating and completing tasks and participating in motivation flows, including:

  • tasks (title, category, tags, deadlines, checklists/subtasks),
  • motivational sessions and nudges (“pings”),
  • optional public profiles and a social feed of completion stories,
  • in-app inbox notifications,
  • safety tools (report/block).

No direct messaging (DM/chat) is provided in the current version of the Service.


5) XP, Credits, and virtual items (App)

The Service may include XP, Credits, ranks, or similar virtual items (“Virtual Items”) used to support motivation, progression, and feature access.

  • Virtual Items have no cash value, are not property, and are not redeemable for money.
  • We may change how Virtual Items are earned, used, or displayed, and may reset or adjust balances where necessary for integrity, bug fixes, fraud prevention, or compliance.
  • Attempting to manipulate Virtual Items (e.g., multi-accounting, automation, abuse of systems) is prohibited and may lead to restrictions or termination.

6) Your content (UGC) and permissions (App)

User Content includes your profile info (including username), tasks, nudges, photos (Proof of Work), reports you submit, and other materials you post or upload.

You retain ownership of your User Content. However, you grant Focido a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, and process your User Content only to operate, provide, maintain, and improve the Service (including moderation, safety enforcement, and troubleshooting).

Public visibility: If you choose to make content public (e.g., public profile or feed stories), other users may view and re-share it. You are responsible for what you choose to share.


7) Rules of conduct (Acceptable Use)

You agree not to:

  • violate any applicable law or regulation;
  • post content or choose usernames that are illegal, threatening, harassing, hateful, or sexually exploitative;
  • share personal data of others without permission (e.g., doxxing);
  • impersonate others or misrepresent your identity;
  • spam, manipulate engagement, or attempt to artificially boost XP/Credits/Virtual Items;
  • upload malware or attempt to interfere with the Service’s security or functionality;
  • reverse engineer, scrape, or access the Service using automated means except as allowed by law;
  • exploit the Service in ways that harm other users or the platform.

We may remove content or restrict accounts that violate these rules.


8) Reports, blocking, moderation, and enforcement (App)

The Service includes report and block features. We may (but are not required to) review reports and take actions such as:

  • removing or limiting visibility of content,
  • restricting features,
  • suspending or terminating accounts.

Our enforcement decisions are made at our discretion, consistent with these Terms and safety needs.


9) Subscriptions, purchases, and billing (App)

Focido may offer paid features such as Pro subscription.

  • Billing platform: Purchases are processed by Apple App Store or Google Play (in-app purchases). Your purchase is governed by the store’s payment terms.
  • Subscription management: You can manage or cancel your subscription via your Apple/Google account settings.
  • Refunds: Refund requests are handled under Apple/Google policies and processes and any applicable local consumer law.
  • No payment card storage: We do not store your full payment card details.

10) Marketing communications

If you explicitly opt in, we may send marketing or reactivation emails. You can opt out at any time (e.g., via unsubscribe link or in-app settings where available).


11) Third-party services

The Service may rely on third-party providers (e.g., hosting, storage, analytics, crash reporting, subscription infrastructure, website tooling). We are not responsible for third-party services outside our control.


12) Intellectual property

The Service, including software, designs, and branding, is owned by Focido and/or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission.


13) Availability and changes

We may change, suspend, or discontinue any part of the Service at any time, including features or availability. We are not liable if any part of the Service is unavailable.


14) Termination

You may stop using the Service at any time and may request account deletion in-app.

We may suspend or terminate your account if:

  • you violate these Terms,
  • your use creates risk or legal exposure for us or others,
  • we must do so to comply with law.

Where appropriate, we may provide notice, but we are not required to do so in urgent cases (e.g., safety/security).


15) Disclaimers

  • The Service is provided “AS IS” and “AS AVAILABLE.”
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure.
  • Focido is not a medical, psychological, legal, or financial service. The Service is intended for productivity and motivation support only.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.


16) Limitation of liability

To the maximum extent permitted by law:

  • Focido will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.
  • Our total liability for any claim relating to the Service will not exceed the amount you paid to use the Service in the 12 months before the event giving rise to liability (or €10 if you have not paid anything).

Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.


17) Indemnity

You agree to indemnify and hold harmless Focido from claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of:

  • your use of the Service,
  • your User Content,
  • your violation of these Terms or applicable law.

18) Governing law and disputes

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules.

If you are a consumer in the EEA/UK, mandatory consumer protection laws in your country of residence may also apply.


19) Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice in-app, on the website, or by other appropriate means. The “Last updated” date indicates the effective date.
